Article 1; Introduction
At Artflower we want to ensure that relationships with our customers run as smoothly as possible. We appreciate the trust you place in Artflower and therefore take your rights very seriously. With the sales conditions below, we want to give you a clear and clear overview of your rights, and sometimes obligations. If something is not clear, we would appreciate it if you tell us.
Article 2: Price
All prices quoted are always inclusive of VAT and all other taxes payable by the customer. If transport, reservation or administrative costs are charged, this will be stated separately. The price indication refers only to the articles as described verbatim. The accompanying photo is decorative and may contain elements that are not included in the price..
Article 3: Online purchases
The customer has the opportunity to purchase the articles from the Artflower range online. The consumer has the right to Artflower. to state that he / she renounces the purchase, without payment of a fine and without stating reasons within 14 days from the day following the delivery of the good. Each customer user is responsible for accessing his / her account, including the personal username and password. These access keys are strictly personal and confidential. Consequently, they cannot be transferred or transferred to third parties. The customer must take all measures to avoid that his / her personal account could be used by third parties, in particular minors. Anyone who places an order on the website confirms by the order to be a natural person and, moreover, legally competent. Minors or other incapacitated persons are not allowed to purchase online. The working language of the concluded agreements is Dutch. Customer service can always be contacted in case of uncertainty. The purchase is made when the customer receives a confirmation email from the seller, with the invoice added. VAT is also stated on the invoice.
Article 4: Delivery
Delivery is possible in the following countries: Belgium, the Netherlands, France, Luxembourg and Germany. The seller undertakes to process orders placed on the site while supplies last and within the restrictions set out in these conditions. The delivery of the ordered item takes place in Belgium either at the address specified by the customer, or by collection from a postal point or post office, by collection from a Bpack 24/7 parcel machine or by collection from an Artflower store itself. Delivery to other countries takes place either at the address specified by the customer or at the chosen post office or postal point. The chosen delivery option / chosen country influences the delivery term. When the customer chooses to send to an address, an e-mail is sent when the delivery is given with bpost. The customer can follow the shipment via the bpost e-tracker via the tracking number stated therein. The delivery period only starts after receipt of payment. We strive for the shortest possible delivery time. The delivery period is a minimum of 1 day and a maximum of 30 days after receipt of payment for delivery in Belgium, and a minimum of 2 and a maximum of 30 days in other countries. Each delivery is announced via email. The delivery is accompanied by a delivery note, which also shows the details of the delivered goods and a return form.
Article 5: Right of withdrawal
The provisions of this article only apply to customers who, in their capacity as consumers, purchase articles online: the consumer has the right to inform the seller that he renounces the purchase, without paying a fine and without specifying a motive within 14 days from the day following the delivery of the product. Each ordered item can be returned or exchanged for another item at Artflower within fourteen calendar days. The item must be delivered in the original packaging together with the return form. The customer is either refunded or receives a voucher. The customer can also return the item by post. The returned product must be returned in new condition (including with barcode sticker), in its original packaging, in perfect condition and with a fully completed return document. Only items that are in the original and undamaged packaging, together with all accessories and proof of purchase can be taken back. What will in no case be taken back: - used, soiled, damaged or incomplete items - items that are tailor-made for the customer - items that cannot be returned due to their nature. Returning with bpost is free of charge. To do this, the return label must be affixed to the outside of the box, after which the box will be delivered to the post office and shipped at the expense of the seller. For any other form of return, the customer is responsible for all costs. In case of loss / loss of the sent package, the burden of proof lies with the customer. He must be able to prove that it was sent to the seller at the given address. After handling the return, the customer will be refunded by the seller via the payment method chosen by the customer. The refund will be made within 30 days of receipt of the return by the seller, provided that all requirements as described above are strictly met. In any case, the amount that will be refunded will never exceed the amount actually paid by the customer. If a coupon was used during the purchase, it will also be returned. This voucher can then be reused on a subsequent purchase. Any return for which the sender cannot be identified will be refused and returned to the sender.
Article 6: Complaints
Any visible damage and / or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately to the customer service, under penalty of forfeiture of any right. As evidence, the customer accepts that electronic communications and backups can serve as evidence. The customer is solely and solely responsible for the accuracy of all data he or she provides.
Article 7: Warranty
Under the Act of 21 September 2004 on the protection of consumers when selling consumer goods, the consumer has legal rights. Each item purchased is subject to this legal warranty from the date of purchase by delivery to the first owner. Any commercial warranty is without prejudice to these rights. To invoke the warranty, the customer must be able to present the product and proof of purchase. For all articles, the customer must contact the customer service of the seller in advance, after which the customer must return the article at his expense to the seller. The (commercial and / or legal) guarantee never applies to defects that arise due to accidents, neglect, falls, abnormal or incorrect use, use of the item for any purpose for which it was designed, failure to follow operating instructions or manual, modifications or changes to the item, heavy use, poor maintenance, abnormal or incorrect use.
Article 8: Privacy
The seller undertakes to use your data exclusively for the execution of the concluded agreement that you conclude through your order and to send you information from the seller without obligation. If you also want to receive information by e-mail, please also provide your e-mail address. We treat your data as confidential information and will never pass it on, rent it or sell it to third parties. You can request, correct, change or delete your data that we keep in the customer list of the webshop at any time and you can refuse that the seller uses your data to send you information. The customer is responsible for keeping his login details confidential and the use of his password. Your password is stored encrypted, so the seller has no access to your password. The seller keeps online (anonymous) visitor statistics to see which pages of the internet site are visited to what extent. The website www.artflower.be was created on behalf of and is managed by the seller. Users may view and print the information on the site for free for personal use, but not for commercial purposes.
